patents. Apple doesn't manufacturer their own products but they do design and come up with the technology. They pay others to implement them. Sometimes they use others technology if they haven't produced that component or a better one as of yet. I'm not 100% sure but that's what I would assume. Samsung may have the ability to manufacturer the design based on apples specs but don't own the patents to the technology/processes for them.

It’s first gen tech. It never goes how it’s supposed to. Samsung will take the user data and note the failure points, improve them, and release them with the 2nd, or maybe even the 3rd gen once the tech has moved closer to perfect

Its is like with the apple watch. "When Apple releases a smartwatch, they will make sure it has at least 2 weeks battery life per charge!", at the end the battery life, is just as bad as the others. The Apple Fold will have a crease too.
