If there has been no previous succession and you can prove you live in the house 12 months prior to your mother death, you should be entitled to succeed the tenancy. Go to your local MP /councillor for support with this matter. Good luck

Contact Law centre or Shelter for housing advice, your local MP, local radio and TV station. Don’t move out, let them take you to Court and present your case to a judge. You have a child that alone qualifies you to be in priority need for housing. If they evict you they must rehouse you and your child by law. They can’t assume that you can afford to rent privately if its not affordable that also must be presented to the judge.

Writersroom :
If you and your daughter lived with your parent for more than one year, (I know you said you lived there all your life) were registered at that address, were named on the tenancy as your main abode, were on the council tax as living there and contributed to the council tax if required, and as long as no right of succession has been exercised previously, then you have the right of succession. If the property is too large for your needs, ie. Under occupied and the council are unable to find you suitable accommodation then you have the right to remain until they find you accommodation to fit your requirements . You may have to pay bedroom tax if the property is too large for your needs. Please seek legal advice.
