Both are correct. Herod was the king of the Judean nation, but the nation was under the governance of Rome. Herod was only as powerful as Caesar Augustus allowed him to be and would have been removed from power if he went against Roman rule.

They answer different questions: Matthew: Who was ruling Judea when Jesus was born? King Herod. Luke: What event caused Joseph and Mary to travel to Bethlehem? A census ordered by Caesar Augustus. These can both be true at the same time.
