As a family solicitor for a specific wealth band of client in the uk, we've known this for quite some time. On a potentially positive note though, there is reform taking place in the family courts and official guidance regarding domestic abuse at the moment, thanks largely to the work of Claire Throssell

Not surprised, mine claimed emotional and psychological abuse because I asked him to be consistent and pick which days so he started an argument with me then stopped replying. Still had to pick the days in court though and not stick to them 🙄

Mine got a 3 year sentence for DV and just had a section 7 recommending no contact. Just had court and he said it's all because I'm a liar and alienating the children 🫠🫠

Mine did. Had to do a whole Section 7 that found no evidence, and this was after he was subject to police action when we split.

Im convinced the whole "women don't get custody and are falsely accused" shtick was started by bum deadbeat dads who didn't bother going to court over custody and now wanna use that as an excuse as to why they didnt

This is totally not my lived experience. I tried for simply every other weekend for contact as I was living in a small flat at the time because my money was, quite rightly, going to keep the former family home so the kids had that for stability. I was met with a 40 point Scott Schedule, when the judge had asked for 5, all of which were layers and layers of false abuse claims. To fight this it would’ve taken a full fact find hearing that neither of us had the financial resources for, so I ended up on an agreement of supervised visits and no overnights 😔 We’re now about 8 years down the line from that and I’ve never really been able to recover from that position and now rarely see the kids. So I’m sat waiting to see what decisions they make for themselves as they get older. There was no support in the family court or local authority systems, the only route was more lawyers, more barristers, more judges and more money & trauma for everyone.

I think the large problem here is statistics in family courts (regardless of what they are pointing out) are completely inaccurate. Especially in regards to false allegations. This isn’t just a family court issue but an issue about how data is collected and a logical issue too. How do you know a liar is lying? By asking them and them confirming or by someone else simply saying yup they are lying?! Then the validity of the second person must be questioned. And if the second person in this scenario is a judge through a fact finding hearing then that is subjective too. Plus us family court system is different to UK family courts. I mean the whole legal aid situation is different (which in the uk can be a large trigger for false allegations). My point being statistics and studies in these matters are extremely subjective.

I did some work within the domestic abuse industry, and it is a well-known fact in organizations that work with both male and female victims that it is men who are more likely to lie about domestic abuse from the offsets. they will often do it in order to prevent their victim from access. I worked in a female only support centre, and we still had perpetrators phoning up and trying to DARVO.

My daughter’s father used the family court system to further abuse me and then her. He dragged my name through the mud and made up so much about me. I told a fraction of what he did and was made out to be crazy. The courts tried to give him 50% custody and threatened to give him 100% if I didn’t ask the criminal court system to take the restraining order they put in place away (I never asked for it, the judge made that decision). I will never forgive the family court system for what they put my daughter through!!
