Restaurant has the right to charge a tip. If it is stated up front, then they have the right to charge you. They do it all the time with groups. They can apply it to frequent non tipping guests as well.

If they charged your card the fee when the original bill did not have it, I would have them remove it. pretty sure it’s illegal after the fact. Then report them to the proper authorities.
