This is very true obviously but it is not "technically sexual assault ". It IS sexual assault - the victims still go through the same thing others do, the only difference is the assaulter. they dont understand it obviously, but doesn't change the impact it has on the victim

ive held a human brain that had dementia. it is not a normal brain. physically it is horrific, I can only imagine what it must be like to have it. they truly dont always know what theyre doing

Did people forget that there’s a whole thing in our legal system about needing to prove someone has the mental capacity to understand what they’ve done??? Not to say that our legal system is always great with how it runs, but the idea is good!

it seems like the problem with this conversation (and honest most regarding the legal action that should follow SA) is that people care more about their own retribution or hate for perpetrators than they do about preventive measures and resources for victims. you do not want to help the victim try to overcome the traumatizing experience you just want to get some sort of vengeance

Guys why is this even a debate dementia patients literally dont make there own decisions they are by definition disabled and un well they dont even remember who they even are whos too say they understand right from wrong when there brain is deteriorating

As a health care worker, I kinda agree. But some ppl with dementia know what they are doing. Not all dementia is extreme.

Dementia can progress to the point where people’s brains can’t even reminder to breathe or pump blood throughout their bodies. This occurred in a hospital. People with dementia are still humans who can’t care for themselves. You can’t put someone in jail for crimes they can’t mentally comprehend. They’d still need a caretaker which means these situations would still occur because they cannot CONTROL themselves!

she isn’t saying victims shouldn’t or can’t feel the way they do when this happens. she is saying the assailant isn’t physically capable of remembering committing the act. chart it, report it, 100% say something and get the support you need and deserve, but an assailant suffering from dementia/alzhiemers likely cannot be held liable for almost any crime due to their mental state and would be declared too mentally unsound to be punished.

you all obviously have never had a relative who has had severe dementia. they are not in control of there actions, a person who has dementia is not the same person they were before there brain went through this change. they physically cannot comprehend what they are doing or saying, and would never do these things if there were not demented.

i know you‘re right and it‘s not their fault but knowing that doesn‘t necessarily make it easier to deal with. idk i do think it was kinda fucked how i was an 18 year old getting sexually assaulted at work and then still having to finish my shift

I work in geriatric psych and these comments make me SIIIIIICK. These elderly folks have not a single fuckin clue what’s going on. I’ve had one follow me around and call me mama. I’ve had them lay there and SHRIEK for their parents, husbands, children. They don’t know. They’re childlike, they’re scared. Does that make it okay? Absolutely not but there’s only so much you can do to manage it. They’re sent to us for a reason. This is just sad, it’s sad they can’t understand that they are NOT there anymore.

It doesn’t matter if they’re ill, old or disabled - if someone is assaulted under any circumstances, a crime has been committed and that victim needs support, not being told ‘aww but they didn’t mean it :((‘ yes they can’t be put on trial, but it doesn’t mean that it should be DISMISSED for the victims sake
