Well, technically, the crosswalk was still indicating that you could walk. So the biker was using the crosswalk so the car is at fault.

This depends on city and state. In NYC undoubtedly this is the bike rider’s fault because bicycles are not allowed on the sidewalk, and also the bicyclist is on the wrong side of the road. The bike rider could be cited. In Tampa it is the driver’s fault unless the intersection is in a designated business district, then it is the bike rider’s fault just as in NYC. In most suburban towns, however, the driver of the car would likely be considered at fault.

Why are we talking in absolutes like bike laws are universal across the country. There are different rules in different states and even different cities in the same state. Some areas permit bikes on sidewalks, some do not. Some areas treat cyclists in a crosswalk as a pedestrian, some do not.

It’s is the cars fault. They are required to make sure they are clear in both directions. As you said he only checked one direction but not the other direction. This could easily have been a person walking.
