If you’re talking about Robynn Europe she did not argue that she was never late. she produced swipe-card records of non-black mangers who had similar or worse attendance and never even written up. she also showed that she complained about hostile work environment and sexist comments. the jury of her peers found that she was discriminated against.

She was documenting. She took out her notepad and ink, pen, and documented everything around her, including her late arrivals to work. And one can only assume it painted a picture that looked like racism. Documenting is so important.

I think that it’s because she was not treated equal as other employees with the same behavior. Where someone else was given leeway she was disciplined for the same behavior and that’s on period. 💅

It sounds like she proved a precedent had been set company wide for tolerance of tardiness and made an argument her lack of tolerance leading to her being fired was due to rave.
