The judge in Kouri Richins' murder trial on Friday designated two rows in his courtroom gallery for Eric Richins' family to use during closing arguments on Monday. By doing so, he eliminated all public seats in the gallery, meaning no one other than designated journalists and family of the defendant and victims can attend closing arguments. Attorney Heidi Nestel, who represents the family members and is executive director of the Utah Crime Victims Legal Clinic, asked Judge Richard Mrazik in Utah’s Third Judicial District to reserve two rows for Eric Richins' family because "there are a lot of people who loved Eric and supported him and who would like to be here that day." "And to prevent people from having to camp out all night at the court stairs ... just to make sure that they get in, our request would be that they get the second and third row," Nestel said. During trial one row was reserved for Eric's family and supporters and one row for Kouri's family and supporters, with the row being front or back depending on if the date is odd or even. One row was designated for members of the media, and two rows were designated for members of the public. To accommodate Nestel's request, Judge Mrazik on Friday (March 13, day 14) reserved an extra row for both Eric's and Kouri's supporters, and reserved one for media. "What I can't do is change the rules regarding odd and even midstream based upon genuine empathy for one side or the other. But I can steal some rows back from people that do not have a familial connection to the case," Mrazik said. "This is going to be the plan for closings on Monday and the period of jury deliberations: First row, as usual, will be for members of the media with authorization to have a seat in those rows. Whichever family, whether it's Eric Richins' family and guests or Kouri Richins' family and guests, is entitled, under the current odd-even switching scheme, to the first or to the second row, will get the second and third. Whichever family, instead of guests, is entitled to the fifth, will get the fifth and fourth. Keep in mind, they're going to switch each day, so if the jury keeps deliberating into Tuesday, it'll be two and three versus four and five switches." The judge asked journalists to help inform the public there's no room in the courtroom for them. "To the extent you can include this in your reporting about what's coming on Monday, I'd appreciate it, just so people aren't showing up unnecessarily," Mrazik said. #judge #lawyer #crime #court
