Take out the fact that he brake checked you. If he had a legit reason to brake- deer, dog or another object was in the road that he was trying to avoid, you would be at fault for rear ending him because you were following too closely. There could be some comparable negligence here for sure.

Insurance supervisor here. We would do a 50/50 decision. Truck at fault for brake checking. Car at fault for following too close. Always allow enough room to be able to brake and avoid what’s ahead of you. And break checking is illegal.

I think everyone needs to go back to driving school, if the sedan was following a safe distance he would have had time to stop in a case of the truck braking, although the truck driver did brake for no reason, if there were to be any reason for him to brake then the sedan should have been keeping a safe distance from the start to avoid any collision if the truck driver was avoiding something ahead of him.
