One of the few things I remember for no obvious reason from law school 35 years ago is the common law definition of theft: “the trespassory taking and carrying away of the personal property of another with the intent to deprive them permanently of their property.” We got this correct because his taking and carrying away was without intent to deprive; that formed later. As you said about Texas (and California, where I went to law school) the common law formula has been generally been abandoned in favor of broader theft definitions.

Why follow the law if it's not just?
It has to be strictly at that point that Greg takes it to count as theft, but if then if he did not know, then he gets away with theft later, and someone loses their three thousand dollar watch.
Theft should count at any point in time that you have the wrong item if, and when, you know that it is not yours and you intentionally keep it.
If you don't know, then return the wrong item when you do, then you should not be found liable, because you do intentionally take to keep something that is not yours.

Now if the wife knew and did nothing and went along both but if she was simply the mule she’s gonna maybe have to be able to prove that from a defense stand point unless the husband admits he acted alone without her knowledge
