This is NOT a violation. Your boss IS allowed to ask you, you don’t have to reply, but it’s not a violation to ask you. The violation would be if the boss called your surgeon and was asking questions and getting any information

Inappropriate? absolutely. A HIPAA violation? NO. So tired of all this "somebody asked me about my health, that's HIPAA!!!" Nonesense. HIPPA has to do with healthcare professionals! If I, a pharmacy tech, decided to come home and start telling my boyfriend patient names, diagnosis, medications, or anything that could identify the patient. That would be breaking HIPAA. Me answering a call from the local jail and giving a medication list for a new inmate once I've verified that it's another health professional so that the patient continues getting their meds? NOT HIPAA VIOLATION. Me telling a story about a ridiculous patient interaction at work and changing names, conditions, medications, etc so that there's nothing to tie that story to a specific patient? ALSO NOT HIPAA violation. My dad's boss (or even another coworker) asking him about his recent doctor appointment? Still not a HIPAA violation, though could be considered inappropriate depending on the coworker relationship.

no manager has the right to know what your FMLA is for. If the employee wishes to divulge that information to you- that's their business. All HR needs to tell you is that the employee has FMLA that has been approved from date to date. They will not tell you what their FMLA is for.

You actually don’t have to tell your boss why you are taking leave. And as a boss, absolutely file a complaint with HR. If you put in by the required time, and it’s already approved, they have no say so.

That is not a HIPAA violation. HIPAA pertains to medical professionals releasing info to people that are not involved in treatment payments and operations. This a gross overstep on the managers part but it’s not illegal.

Not a HIPPA violation because she isnt a medical professional. However, she has a right to ask but you have no obligation to respond to any questions about what the medical leave is for especially if it was previously approved.
