she is getting out intentionally, she is in heat and trying to get pregnant. if the babies can eat wet food, she can get spayed, the kittens will be fine.

He can't be blamed for her getting out. I know I have a cat who just sits and waits for any opportunity for that door to open so they can bolt out of it. Too, he has to wait so long before she can be spayed because she's still milking.
