Tyler Robinson's lawyer Kathy Nester cross-examined the first witness in his preliminary hearing today. Nester is a criminal defense lawyer in Utah who recently defended Kouri Richins, the woman sentenced to life in prison after a jury convicted her of aggravated murder for poisoning her husband by spiking a Moscow Mule cocktail with fentanyl. She's Robinson's lead defense counsel in his capital murder case for the Sept. 10, 2025, fatal shooting of Charlie Kirk during a Turning Point USA event. A preliminary hearing began today (Monday, July 6) before Judge Tony Graf in Utah's 4th District Court. Graf is to decide if enough evidence supports Robinson's charges, which include aggravated murder, a first-degree felony; discharge of a firearm, a first-degree felony; two counts of obstruction of justice, second-degree felonies; two counts of tampering with a witness, third-degree felonies; and a misdemeanor count of violence committed in the presence of a child. The first witness was Chris Bagley, a senior officer with the Spanish Fork Police Department who heard the gunfire that killed Kirk and saw Kirk slump over at the same time. Bagley saw an empty pistol holster in a grassy area after the shooting, but he testified he knew the gunfire he heard came from a rifle and went to the roof of the Losee building after realizing its vantage point to where Kirk was shot. Nester followed up in cross-exam.

Nester asked. "I did," Bagley answered. "Was it ever fingerprinted to your knowledge?" Nester asked. "I have no idea," Bagley answered.
