until the government changes the law as to who can claim the child as a dependent, this argument will be never ending. currently the custodial parent gets to claim the child dependent but doesn't claim the support payment as income, and the payer does not get to claim the payment as a deduction.

My brother was ordered to pay 3700 a month. It left him basically homeless three states away. He quit. Took a lower paying job in the state where his kids lived and she still refused to cooperate with an adjustment or more visitation. The bottom line she said to the judge to throw him in jail if he didn’t pay the 3700 and even the judge was like are you crazy he makes all the money and will not be able to pay you anything and she said she did not care. It was about revenge and not about the kids. I mean he did cheat and he was wrong but the entire divorce just damaged those kids and it was sad and ridiculous. He could not do 5059 due to travel so he needed to pay child support but it was completely insane to end up homeless.

child custody should NEVER go to one or the other based on income alone!! A detailed history and background needs to be done first and foremost. Secondly, child support needs to be a set amount no matter WHAT income either parent makes. Just like minimum wage there needs to be a formula to figure out the baseline for what is needed to support each child then non-custodial parent pays 50% of that. All extra expenses should be requested through FOC if parents cannot work together. In my case, my ex was a severe alcoholic and drug addiction, he made more money than me but no way in hell should he get custody!

yes unless you live in West Virginia and your child's father has multiple children your income is then taken and the normal amount of child Support is deducted and then that amount is split between however many children he chooses to have and I only know this because my son is his father's first child it didn't work out with us he went on to have two more baby mamas with multiple children each

I've seen several comments about 50/50 and there'd be no more support. There'd still be child support because support and visitation are separate in most if not all states. He was petty taking a pay cut just so he couldn't afford the same amount but there's probably layoffs and what not, possible. Anyone who would intentionally sabotage their own ability to earn should not have primary custody. My ex-husband did this. It’s obvious and judges can spot it. My ex got roasted by the courts for it and never had a shot at primary custody.
