Attorney Brian Panish told jurors today they won't hear "forthcoming testimony" from Rebecca and Peter Grossman's defense in the punitive damages phase of the Iskanders' wrongful death lawsuit trial. The jury on Wednesday said Grossman and Scott Erickson are liable for $176 million in compensatory damages for the deaths of 11-year-old Mark and 8-year-old Jacob Iskander. Jurors agreed Grossman and Erickson acted with malice and/or oppression, which entitles the Iskanders to punitive damages. Panish said in his 26-minute opening statement this morning that jurors will "see evidence of attempts to transfer money, evade collection and prevent the Iskanders from getting money from the Grossmans. "We're going to show you that that's been going on for a long time, and this has been a scheme that has been created by Dr. Peter Grossman, Rebecca Grossman, and others," Panish said. Evidence includes recorded calls "and they're going to talk exactly about that subject and making sure that Panish and the Iskanders do not get to get to any of their assets." "This is long before you've reached your verdict in this case," Panish told the jury. He said the purpose of punitive damages is "punish a wrongdoer for conduct that harm the plaintiffs in this case and discourage similar conduct, not just to them, of everyone in our society." "You're going to set a message that this conduct is not tolerated, and it's going to stop others from engaging in this conduct," Panish said. "That's what this punitive damage part of the trial is going to be about, sending a message to not only Erickson and Grossman, but to everyone in our community that this conduct, if you do it, you're going to be punished. And if you can deter some people, that's going to make it all worthwhile," he said. Testimony continues on Friday in Los Angeles. #law #court #attorney
