Judge Huey Cotton thanked the jury today before he officially released them from service in the Iskanders’ wrongful death trial against Rebecca Grossman and Scott Erickson. The 12 jurors awarded $22.17 million in punitive damages on top of the $176 million in compensatory damages they awarded last week, for a total of $198.17 million. Grossman and Erickson each are liable for the $176 million, while Grossman is to pay $21 million in punitives and Erickson is to pay $1.17 million. Grossman is serving 15 years to life in prison for hitting and killing brothers Mark and Jacob Iskander while speeding and impaired in her Mercedes-Benz AMG in Westlake Village, California, on Sept. 29, 2020. Prosecutors dismissed a a misdemeanor reckless driving charge against Erickson, a retired Major League Baseball pitcher, after he recorded a public service announcement about safe driving with Grossman’s assistance. He was speeding near Grossman when she hit the boys, and witnesses said they were racing. The jury in the civil trial heard opening statements on April 25. “I just want to personally thank each and every one of you, and the alternates,” Judge Cotton said after his clerk published the final verdict about 11:40 a.m. today (Wednesday, June 10) in Los Angeles. He said he “can’t imagine” what the alternates went through as the 12 deliberating jurors met privately. “I know you didn't get to participate in Taco Tuesday with the rest of the group, and that was, that was a loss,” said Cotton, a Los Angeles County Superior Court judge since 2009. “But we can't have asked for a more attentive jury and more conscientious jury, a more focused group of individuals, you've been exemplary, and for that, on behalf of everyone, I thank you,” the judge said. He cautioned “that certainly the media is going to try to talk to you.” “You decide,” he said. Cotton said it’s “customary” and “a good thing” for the jurors to talk to the attorneys. “It helps everybody, but only at your time and your place,” the judge said. I am writing an article about the trial and verdict(s) for my Substack mailing list, www.legalaffairsandtrials.com. You can watch all testimony and arguments on my YouTube channel.
