A Utah investigator identified Tyler Robinson as the suspect in the murder of Charlie Kirk during the first day of Robinson's preliminary hearing in his capital murder case on Monday. David Hull, an agent with the Utah Department of Public Safety, testified about learning Robinson's name from authorities in a nearby county who said he wanted to turn himself in. "Would you recognize that person if you were in the courtroom today?" asked David Sturgill, chief of the Utah County Attorney's Office's Special Victims Unit. "Yes," Hull answered. "Is he in the courtroom today?" Sturgill asked. "He is, yes," Hull answered. Robinson's lawyer Kathy Nester objected to what she called an "unduly suggestive in-court identification for constitutional grounds." She said asking a witness to identify the defendant when the defendant is the only one "sitting at the table with defense counsel" is "unduly suggestive and taints any future or past will definitely future identification." Judge Tony Graf heard brief argument then said he's "not finding that particular question as previously posed as suggestive." "I find for the purposes of this hearing only, that in-court identification by Agent Hull of Mr. Robinson has been made. Again, this only relates to the preliminary hearing," Graf said. But Hull never actually identified Robinson, so Sturgill revisited the issue later in the exam with Graf's permission. "Would you please point him out and identify something that he is wearing?" Sturgill asked Hull. "Yeah, I believe that Mr. Robinson is between Ms. Nester and other counsel, wearing a gray suit jacket with a dark tie and a light-colored shirt," Hull answered. "I would ask that the record reflect that Agent Hull has identified the defendant," Sturgill said. Nester said she "made my objection already." The judge said, "For the purposes of this hearing, I find that Agent Hull has identified Mr. Robinson. Again, this is only for the preliminary hearing."
