Attorney Brian Panish played former Major League Baseball pitcher Scott Erickson’s public service announcement about safe driving while questioning him in the punitive damages phase of the Iskanders’ wrongful death trial. First, he asked Erickson about his testimony in the liability phase that “you still continue to drink and drive, correct?” “Yes,” Erickson answered. “So you would agree that it must be, have to be a serious penalty to get you to stop drinking and driving, correct?” Panish asked. Judge Huey Cotton overruled an argumentative objection and Erickson answered, “No.” Cotton sustained a relevancy objection when Panish asked, “So you’ve quit drinking now,” so Panish moved into questions about the purpose of punitive damages. “Do you know that punitive damages - one of the purposes, there's two - is to deter others from engaging in similar conduct that you did. Do you understand that?” Panish asked. “I understand,” Erickson answered. “And you understand people are going to look at this case and see what happened. … What was the punishment, right?” Panish asked. Cotton sustained a relevancy objection so Panish asked, “You would agree, would you not, sir, that if the jury were to punish you and deter one person from causing a drunk driving racing incident, that would be a good thing, right?” “If it can stop other people,” Erickson said. Panish played a portion of a public service announce Erickson filmed before prosecutors dismissed his misdemeanor reckless driving charge. Erickson was speeding near his girlfriend, Rebecca Grossman, when she hit and killed Mark and Jacob Iskander in a crosswalk in Westlake Village, California, on Sept. 29, 2020. Grossman is serving 15 years in prison, and jurors in the civil wrongful death trial said Erickson and Grossman are liable for $176 million in compensatory damages. Erickson said in the video, “If this video could help save one life, it would be worth it. Please be careful out there.” “So, you'd agree with me, sir, that the jury punish you enough to deter just one other person, that would be a good thing, right?” Panish asked. “I think I said the video could help somebody,” Erickson said. “Could you answer my question, sir? If the jury were to punish you enough that it will deter others, just one person from not killing someone racing and drinking, that would be a good thing to come out of this, wouldn't it?” Panish asked. “Uh, it would be a good thing if,” Erickson said. “You agree?” Panish asked. “I’m not quite sure,” Erickson said. “You're not sure.
