The craziest thing about this is that it was likely avoidable. I'm sure Van Leeuwen sent Rebel a cease and desist before they sued. Why didn't Rebel just change their packaging 🤦🏾♀️?

Not surprising. Solid full package pastel color, with a black script font wordmark centered large on the front. That's conceptually the same design. If Rebel had done the lids in a contrasting color, or added a pattern to the main color, or chose to show their logo in any other way than plain black script, they might have won. But trade dress is about the combination of product presentations that are protected.

I don’t think people understand the law here. Yes, they look similar, but I’d argue consumers would not confuse the two and therefore this ruling is a little wacky. Other lawsuits like this where the infringing party was very clearly copying did not rule in favor of the original brand because of what I stated so I feel this doesn’t fall in line. With that. Anyways, I have no stake in this because I’m not stupid enough to spend $8 for a pint of generic ice cream lol.

I love packaging and am drawn to a product that has nice branding. I think van leewan’s has such a great palette and looks so clean, I’ve seen rebel and never thought they were trying to copy though. I do see the similarity but as a consumer it didn’t draw me in like van leewan

Yikes! Rebel also had a class action lawsuit against them for misleading saturated fat content in their products, back in 2022.

I never buy anything with big numbers on it like that. I assume it has weird ingredients. So I would not confuse it for that reason
