Joshua Kaze used to play sports and hunt with Eric Richins after they became friends in 2014. Kaze testified in Kouri Richins' murder on Thursday (March 5, day 9) about his late friend, whom he described as outgoing, confident, dependable and not a drug user. Kaze also testified about a phone call he received on Valentine's Day 2022, but he couldn't say what Eric told him because it would be hearsay. This is the alleged attempted poisoning that is the basis for an attempted murder charge against Kouri Richins, in addition to the aggravated murder charge for the alleged fatal poisoning almost three weeks later on March 4, 2022. Kaze said he remembers the call because "it was unlike any other conversation I'd had with Eric, mostly just kind of his spirits felt almost like somber." "Anybody that knows Eric, most pf the time you would call and he would already be talking upbeat, you know? And this one was a lot different," Kaze testified. "How did he sound to you?" asked Brad Bloodworth, the chief criminal prosecutor in Summit County, Utah. "Like I said, somber would be maybe a way to describe it, very serious," Kaze answered. "Maybe sincere, which can be is a little like, especially for friends that joke around a lot and kind of rib each other quite a bit, which we did, it was just very outside the norm." "Had you ever heard Eric sound like that before?" Bloodworth asked. "No," Kaze answered. "On what Eric said to you, and without saying anything that Eric said, did you offer Eric any advice?" Bloodworth asked. "I don't know that I would say advice other than maybe like questions, like suggestions and questions, is, was my response," Kaze answered. Bloodworth told Kaze he was going to ask him "three yes or no questions." "Based on that conversation, did you ask Eric Richins if he was okay now?" Bloodworth asked. "Yes," Kaze answered. "Did you ask Eric if he was going to go to the hospital?" Bloodworth asked. "Yes," Kaze answered. "Did you ask Eric, 'What are you going to do about it?'" Bloodworth asked. "Yes," Kaze answered. "Sir, after that call with Eric Richins, did you speak to anybody else about that call?" Bloodworth asked. "Yes," Kaze answered. "Who did you speak with?" Bloodworth asked. "I talked to my wife that night about it, and then a day or two later, told a mutual friend, actually two different mutual friends of mine and Eric's," Kaze answered. The trial is back in session tomorrow (Monday, March 9, day 10). Prosecutors expect to rest their case this week, then Richins' lawyers will call witnesses. The trial is expected to end by March 26. #law #crime #court #lawyer
