As millions of baby boomers pass away over the coming decades, more homes in age-restricted 55+ communities will inevitably be inherited by adult children who are under 55. Cases like this could become much more common. Bethany says she moved into her father’s home to care for him while he was terminally ill. After he passed away, she inherited the home in a 55+ community in Jacksonville, Florida. Now she’s in a legal battle with the HOA. The association says the community’s age restrictions don’t allow her to live there because she’s under 55. The dispute escalated when the HOA approved a special assessment of about $1,000 per household, creating roughly a $155,000 legal fund to continue pursuing the case. Bethany has argued that many of her elderly neighbors are on fixed incomes and shouldn’t have to pay for the lawsuit. The interesting part is that this isn’t simply a question of whether someone can inherit a home. In many 55+ communities, owning the property and occupying it are two different legal issues. You may be able to inherit the home, but whether you can live there depends on the community’s governing documents and the applicable laws.
