The new judge in Alex Murdaugh's murder case said today she'll decide later if he can be unshackled and wear civilian clothes during his pre-trial hearings. Murdaugh is scheduled to be retried next April for the 2021 shooting deaths of his wife and 22-year-old son after the South Carolina Supreme Court overturned his convictions last month because of a court clerk's improper comments to the jury.  The 58-year-old scion of a South Carolina legal dynasty is still serving a 27-year state sentence and a 40-year federal sentence for financial crimes related to his decades-long embezzlement from his personal injury law firm clients and others.  His lawyers withdrew their motion seeking to have him unshackled and in civilian clothes for his pre-trial hearings, but Dick Harpootlian renewed it during a status conference today (Monday, June 29) before Judge Debra McCaslin in Lexington, South Carolina.

Wherever this goes, it's going to be difficult to get a jury, and to the extent that bringing him around in a jumpsuit, shackled like an animal, impacts their view, it's going to make it more difficult for us to get a jury," Harpootlian said. He had Murdaugh stand at the defense table. "Chained around the waist. Chained at the hands. Chained on the feet. This guy is not a serial killer. He's not, you know, Ted Bundy," Harpootlian said. "You can sit down, Mr. Murdaugh," McCaslin said. Harpootlian said the trial judge, Clifton Newman, who has since retired, allowed Murdough "to come unshackled in his street clothes every hearing."
