Tyler Robinson’s lawyer Michael Burt mentioned Kouri Richins’ murder case when arguing against suggestions that the jury pool in Robinson’s case could be expanded to account for widespread publicity. "The Utah Supreme Court in a case that Ms. Nester is currently involved in — the Richins case, this is cited in our motion — said that the court does not have the authority to expand the jury pool, so that remedy is not one the court can adopt," Burt told Judge Tony F. Graf, Jr. I met Burt in Boise, Idaho, in 2012 when he represented serial killer Joseph Duncan in a retroactive mental compentecy hearing aimed at overthrowing his death sentence. At the time, he'd for decades exclusively represented defendants in capital cases across the country. Fourteen years later, nothing's changed, and he brought that up today when arguing against suggestions raised by lawyers for news organizations who want to record and stream the hearing live online. "I don't know how many capital cases the media lawyers have been involved in. But for the last 40 plus years, I've done nothing but those trials, and I've been involved with using jury questionnaires, extensive individual sequestered voir dire," Burt said. "And the fact of the matter is that voir dire is not an effective means in these cases.” Extensive questioning of potential jurors also "calls into question other rights," he said. "For instance, in a death penalty case, the jury has to be death qualified: Both those who would automatically impose death and those who would automatically impose life." Burt said. "There's a lot of research which shows the vast process skews the panel as unrepresentative. It excludes people who are knowledgeable because they read this media coverage. It excludes, the evidence shows, minority groups, women and people that normally would be included in a representative jury." Burt said attorneys can ask potential jurors "whether they've heard the president of the United States say that Mr. Robinson should be executed, and you can exclude that juror from serving on this case." "But given the demographics of this county, you're going to be excluding a large portion of the population," Burt said. "When you add to that the death qualification process, you no longer end up with a representative jury. You end up with what the U.S. Supreme Court in Witherspoon v. Illinois called a group organized to return a death verdict. But it's not a representative jury," Burt said. "So as Chief Justice Rehnquist said, in his opinion, even if you employ these other means, they come with a great cost.
