Closing arguments are underway in Kouri Richins' murder trial in Utah this morning (Monday, March 16). Richins is accused of surreptitiously slipping a lethal dose of fentanyl into a cocktail and giving it to her husband, Eric Richins, in March 2022. Judge Richard Mrazik began the day by instructing the jury. It took him about 30 minutes to read the instructions out loud. They included instructions about immunized witnesses and informants. Prosecutors objected to the informant instruction on Friday, but Richins' attorneys said it applies to anyone who provided information to law enforecment while in custtody, and Mrazik agreed it applies to Richins' housekeeper and alleged fentanyl source, Carmen Lauber, and Robert Crozier, who admitted to selling Lauber pills but testified they were oxycodone, not fentanyl. (You can watch Crozier say that here @Meghann Cuniff.) "An informant is someone who provides evidence against someone else for a personal reason or advantage. The testimony of an informant alone, if believed by the jury, may be of sufficient weight to sustain a verdict of guilt, even though not corroborated or supported by other evidence," Mrazik told the jury. "You must examine and weigh an informant's testimony with greater care than the testimony of an ordinary witness. You must determine whether the informant's testimony has been affected by self interest, by an agreement they have with the government, by their own interest in the outcome of the case or by prejudice against the defendant," the judge continued. "You should not convict a defendant based on the unsupported testimony of an informant unless you believe the unsupported testimony beyond a reasonable doubt. A person may testify under a grant of immunity that is an agreement with the government. Their testimony alone, if believed by the jury may be of sufficient weight to sustain a verdict of guilt, even though it's not corroborated or supported by other evidence." "You should consider testimony given under a grant of immunity with greater care and caution than the testimony of an ordinary witness. You should consider whether testimony other a grant of immunity has been affected by the witness's own interest, the government's agreement, the witness's interest in the outcome of the case, or by prejudice against the defendant." "On the other hand, you should also consider that an immunized witness can be prosecuted for perjury, for making a false statement. After considering these things, you may give testimony given under a grant of immunity such weight as you feel it deserves." You should not convict a defendant based on the unsupported testimony of an immunized witness, unless you believe the unsupported testimony beyond a reasonable doubt. Remember the fact that the defendant is charged with a crime is not evidence of guilt." "The law presumes that the defendant is not guilty of the crime charged. This presumption persists unless the prosecution's evidence convinces you beyond a reasonable doubt that the defendant is guilty." #law #crime #court #judge
