Kouri Richins' lawyers called for a mistrial after Prosecutor Brad Bloodworth finished his closing argument in Richins' murder trial in Utah today (Monday, March 16). Kathy Nester read a list of alleged transgressions by Bloodworth that she said warranted Judge Richard Mrazik ending the trial right now and never letting the jury consider Richins' five felony charges. Mrazik didn't do that, but he agreed to instruct the jury after Bloodworth commented on Richins' demeanor at the defense table during trial, which Nester said was an improper invasion of Richins' right to remain silent.

"At multiple points in the prosecution's closing, he made efforts to dehumanize the defendant, in fact, calling her a black widow, comparing her to a deadly spider, calling her a narcissist, when there's been no evidence introduced to support that. No expert testimony, nothing of the nature," Nester said. "Furthermore, is completely improper for the prosecution to comment on her demeanor while she sat at counsel table. That's a comment on her failure to testify, asking the jury to take into consideration facial expressions, which, in his opinion, may or may not have happened. I don't know what he's basing that on, but it's improper." Mrazik said Bloodworth was referring to Richins' friend Chelsea Barney's description of Richins as a "black window." The defense argument that the comment "improperly compares defendant to some kind of terrible insect" "is not a fair characterization," the judge said. Mrazik said "out of abundance of caution" he would instruct the jury "that they may consider their observations of defendant's demeanor in the courtroom, if any, but they may not consider counsel statements regarding counsel's observations of defendant's demeanor." The judge told jurors when they returned to the courtroom, "You may consider your observations of defendant's demeanor during trial, but you may not consider counsel statements regarding counsel's observations of defendant's demeanor, because counsel statements are not evidence."
