Armory v Delamirie (explained simply). This case says that "finders keepers" is actually the law – with one exception. Here's what happened. In 1722, a boy called Armory was cleaning chimneys when he found a jewel. He had no idea what it was worth. So he took it to the shop of Delamirie (a famous goldsmith) for a valuation. Delamirie's apprentice took the jewel to "weigh it" – then came back with an empty setting and offered Armory three halfpence. Armory refused. He wanted his jewel back. But the shop wouldn't return the stones. So he sued Delamirie – who was legally responsible for his apprentice – and won. Delamirie's side argued the boy wasn't the true owner. He just found the jewel, so he had no real claim to it. The court didn't care. It never asked who the true owner was. The rule: if you find something, you have a better right to it than everyone in the world – except the true owner. Possession itself is a property right. You don't need to prove you own something to protect it from someone who takes it. And because Delamirie never produced the jewel in court, the judge told the jury to assume it was the finest jewel that could fit the setting – and award damages on that basis. Hide the evidence, and the court presumes the worst against you. The legal principle is called "relativity of title" – ownership disputes aren't about who truly owns something, just who has the better right to possess it.
