Let me clear this up…that’s my best friend, she was doing her job for a PRIVATE airport. That officer did not have their sirens on and the employee used his badge to let themselves in not her!! She has the FULL video of what happened even from the gate cameras so she was not in the wrong she was told by the Company not to open for anyone at all and to call her manager first doing her job. Ps the charges were dropped and even the judge thought it was ridiculous. 😭😂😂anyways my bestie is good and still employed by them hahaha😁

Aerospace facility is a federal institution and can refuse local law enforcement to enter ! They could very well be terrorists pretending to be law enforcement to enter and do damage

She is security guard to a private property. Of which you do not have permission to enter without a warrant. Maybe exit circumstances could be claimed if they feared he could leave the property from another access point. Otherwise, she didn’t do anything wrong but doing her job, which is to keep people unauthorized from entering the facility.

from reddit: Holy shit for once my experience as both a lawyer and a compliance manager at an aerospace company overlap! The gate guard was right by still objecting; the hot pursuit doctrine does allow police to enter without a warrant but to preserve your objection to unlawful search and seizure (for collateral issues) you still need to refuse. Police can force entry and still be covered by their probably cause defense, but you don't want to give permission to enter a secured facility because you literally aren't allowed to in many instances when you have a security plan that restricts access to ITAR/EAR material, classified materials and sensitive payload management spaces.
Tldr; the guard was right to refuse, the cop was fine to object, but if he felt it was worth it he should have just drove through the gate. Same as kicking in a door. You're allowed to do it in hot pursuit, but that pursuit doesn't make people have to take affirmative actions to facilitate your pursuit.

Comments don’t understand this was an active traffic stop with police in pursuit of a suspect. Suspect can’t drive from a public road into a secure facility to evade police. Cops are right to detain the security guard.

I believe it has to be the sheriff…or deputy. I don’t think city police can access federal facilities.

She didn’t shut the gate. As you can clearly see in the video, it’s an automatic gate. It closes behind every car that enters

It’s a matter who is right or wrong. The security guard can send the driver back out to the police for the Traffic stop.

not a single fuckin commentor defending the cops, has ANY idea what an ITAR controlled facility is or why certain facilities that work along with federal agencies are required to have STRICT access control.

Minor traffic infractions: The U.S. Supreme Court (such as in Lange v. California) ruled that hot pursuit into a home or restricted private area is not automatically permitted for a minor, non-violent traffic infraction unless a true emergency or immediate threat exists.
