look at the stipulations in your HOA contract it literally States somewhere in there that they can authorize and enforce their own rules, as long as it doesn't go against law. and I'm pretty sure that the law stating when you built the pool that you have to have a safety fence around it can't be taken away from the HOA rules. in other words if it's a law that you have to have the fence up,, the HOA can't do anything about it.
