A judge said today that an Ohio man who killed another man and injured his cousin in a shooting in a park last year likely avoided a capital murder charge because he is mentally ill. Judge Steven Gall said he knows Christopher W. Manning, 25, has "some mental health issues, and that is an issue in our society. "Quite frankly, I'm certain that you received some consideration for that condition. I guess we're becoming a more civilized society, because this fall right within the confines of the definition of capital murder. It really does, and I'm certain that's why you weren't charged with capital murder, because of the fact that you have some mental health issues," said Gail, who presides in the Cuyahoga County Common Pleas Court in Cleveland.Gail sentenced Manning to 32 years to 37 years in prison. Manning pleaded guilty on June 16 to involuntary manslaughter, felonious assault and attempted murder for shooting and killing Jarvis Perryman, 20, and injuring Perryman's 17-year-old cousin in Cleveland's Euclid Beach Park at Lake Erie.Manning told the judge his victims had a gun and shot at him. Perryman's mother, Latisa Perryman, yelled, "How? He didn't have a gun! Where was the gun?" (You can watch her speak to the judge here @Meghann Cuniff.) Judge Gall sentenced Manning to 10 years in prison for involuntary manslaughter, with another three years for using a firearm. Manning could serve up to 15 years for that charge under what the judge called his "Reagan Tokes" sentence. Tokes was a 21-year-old Ohio Student University when she was kidnapped and murdered in 2017 by a man who'd recently been released from prison despite a history of wrongdoing behind bars. Ohio lawmakers in 2019 passed a law in Tokes' name that requires judges to impose a minimum sentence as well as a maximum that can be imposed based on a defendant's behavior in prison. Gall also sentenced Manning to six years in prison for felonious assault and 10 years in prison attempted murder and another three years for using a firearm. He's to serve all consecutively, so his total sentence is 32 years to 37 years in prison. "Sir, I hope that you understand the magnitude of your decisions here. Your choice is not to comply with your mental health treatment. Don't let it happen again for the sake of anybody else out there," the judge told Manning. #law #court
