I have an employee who brings this argument to me (GM) every single holiday.. I'm constantly explaining this "double pay" to him and he says every company he's ever worked for does it that way and I say there's no way thats possible 🙄

The clue was in the context. Any hours WORKED over 40 is overtime. You’re not working during the holiday so therefore it’s straight pay.

In my experience, that would have been 8 hrs holiday, 32 hrs reg, and 11 hrs OT. Maybe it varies by state or I’ve worked for better companies.

There’s a difference. If you WORK on a holiday, it’s over time. If the company gives you a paid day OFF and you DO NOT work, it’s holiday pay, which is standard. She said the company was CLOSED, meaning she did not work that day. It’s 40 hours. It’s not overtime.

this isn't the norm, in my experience (Ohio, science field). Holiday counts towards my 40. So if I did 40 hours in 4 days and have 8 hours for Labor Day, my paycheck is 40 hours regular, and 8 OT.

What fascinates me is how many people don't actually understand some of these rules, regulations, labor laws. Also, If an HR rep calmly says to you you do what you need to do when you threaten to call the state, read between the lines and realize you might be wrong.

my company would pay this as overtime. anything over 40 hours is OT. it isn't the holiday pay that pushed them over, it's the other 11 hours.

I feel like this happens a lot when people go from a service or retail job to a corporate job. Because they are used to actually working the holiday and getting paid time and a half or double(depending on policy)
but most corporate offices are closed and you receive pay similar to PTO.
I have had to explain is so many times to co-workers.

This is a completely different situation, but my husband worked for a guy who would only pay overtime if the total biweekly hours were over 80. So he could work 55 hours week 1 and 30 hrs week 2, and only get paid 5 hours of overtime, when he should’ve been paid 15 hrs of OT for week 1. He ended up getting audited and had to pay back 5 years of unpaid OT to all of his current and former employees. 😅
