Shaykh Ali Al Khudayr said: “As for the label of disbelief (kufr) and the worldly legal consequences pertaining to disbelievers—such chastisement—they do not attach to them because the binding proof (al-ḥujjah) has not been established against them. This is because disbelief signifies denial or belying of the Messenger; meaning that the message of the Messenger reached him, and he subsequently denied it, belied it, acted obstinately against it, turned away from it, or disregarded it. And the phrase 'the message of the Messenger reached him' means that the binding proof has been established against him. As for the label of polytheism (shirk), it is the worship of other than Allah and has no dependency upon [the prior establishment of] the binding proof, as stated by Ibn Taymiyyah in Al-Fatāwā (Vol. 20, pp. 37–38)—which is a highly crucial subject of inquiry. He stated: 'The label of polytheist (mushrik) is established prior to the message'—that is, prior to the binding proof—'because he associates partners with his Lord and equates others with Him.' And you must understand that when the Shaykh [Ibn Taymiyyah] states: 'I do not declare takfīr upon such-and-such,' he is merely negating the label of disbelief (kufr)—pay close attention to this restriction—yet it does not follow that one from whom takfīr is negated is a Muslim or accorded the legal status of Islam or Muslims.
