Great content! I am excited to see a truly substantive conversation on Clarity on this app. The points that stand out to me: 1) Insurance - I think this is a good discussion because if the FDIC can provide insurance for assets that are loaned out, I would think it’s a much lower risk to insure custodial assets/funds that are only released the at the customer’s direction. 2) Tech Focus - I like your focus on technology, and my first thought would be only in overarching concepts, like governance where you make a good point. After seeing the voluminous rules proposed under the Genius Act, I would think agency rules could cover more of the fast changing technology requirements. 3) Remedies - this is a good topic for dialogue. My reading of the Clarity Act, specifically section 1011 (Pg. 128 in the version I’m looking at), preserves private rights of actions for fraud, deceit, manipulation or deceptive practices. The limitations on that section are a bit daunting, but (b)(6) seems to preserve the language of (a)(1) unless I’m missing something in the definitions. I’m interested in your thoughts. Great work!
