This creator is parroting Senator Josh Hawley citing Brown v. Walker from 1896 to claim Dr. Fauci lost his Fifth Amendment rights because of a presidential pardon. Hawley is completely wrong, and so is anyone blindly repeating his talking points without understanding actual constitutional law. Brown v. Walker only strips Fifth Amendment protections when a witness faces zero legal risk, but Biden’s pardon only covers past federal conduct. It provides zero protection against state charges or brand new perjury charges if Dr. Fauci spoke under oath. Going into this hearing, Senator Rand Paul explicitly vowed to put Fauci behind bars, and RFK Jr. warned on national television that they were setting perjury traps using leaked diaries. Dr. Fauci's legal counsel rightly advised him to invoke the Fifth Amendment, and Dr. Fauci was well within his constitutional rights to refuse to play along with an obvious political trap.
