⚖️ USCIS Announces Major Change to the Asylum Process Beginning July 28, 2026, a new DHS interim final rule allows USCIS to refer certain affirmative asylum applications directly to Immigration Court without first conducting an asylum interview. The rule also impacts applicants with pending affirmative asylum applications. According to DHS, this may apply to certain applicants who: ✅ Are barred from applying for asylum. ✅ Are barred from receiving asylum. ✅ Do not merit a grant of asylum as a matter of discretion. ✅ Are not eligible for asylum on the merits of their claim.
