I served on a jury for an employer that did this exact same thing to their employee. Needless to say, they broke about eight different laws. While we were in jury deliberations, I convinced the rest of the jurors that we should increase her award. She got triple of what she was suing for Lol… the defense did not see that coming!!!

I'm a business attorney and I am on the defense side, so to speak. IF ANY of my clients ever pulled this- they would no longer be a client.
It's sometimes hard enough on the employer side when clients do everything right- but people get mad...

I think companies forget we now have federal protections for maternity leave signed in 2023 with job protections up to 1 year after birth. Lawsuit incoming! PWFA covers all states, regardless of state law.

As someone who manages leave and disability, this is crazy work by that employer! I hope she wins BIG! CFRA and FMLA not only protect pregnant women but anyone on an approved leave with those leaves.

I worked for a company that did this to a woman. When they took it to court they justified it by saying they “eliminated her position” because there was “no longer a need for it” and weren’t going to replace the role. Long story short, they ended up paying her out $200k or something
