Days before the Menendez brothers will have a resentencing hearing, California prison officials have just reclassified the brothers as potentially more violent than they’ve been regarded in the past. Los Angeles District Attorney Nathan Hochman says recent Comprehensive Risk Assessments on Erik and Lyle Menendez determined the brothers’ “Risk of Violence” ratings should be increased from “Low” to “Moderate.” Hochman says it’s because both brothers have gotten caught breaking prison rules since submitting their motion for resentencing late last year. According to Hochman, Erik Menendez was caught with an illegal cell phone in January 2025. A senior psychologist from the California State Parole Board said if Erik is willing to take that risk by violating the rules, what does that say about following standards outside of the prison environment? Lyle Menendez also had a variety of rule violations he engaged in, Hochman said. The District Attorney’s office used this information to ask the judge to withdraw the resentencing motion. The court denied the request and set the resentencing hearing for Tuesday and Wednesday, May 13th and 14th.
