On Friday a jury in Western Australia found Yung Filly not guilty for three counts of R. He WAS found guilty for two counts of assault occasioning bodily harm. There are also 3 counts of R that are hung juries. He therefore could face retrial on THREE further counts. But being acquitted does not mean being ‘found innocent’. A "not guilty" verdict means the prosecution did not prove the charge beyond reasonable doubt - for those charges. It’s very difficult for prosecution to prove someone is guilty of R for multiple reasons: Consent is often the central debate. In most cases, there is no dispute that the activity happened, but consent often depends on what happened between two people in private which makes difficult to prove either way. There are rarely independent witnesses. Other violent crimes often take place in front of CCTV, or police have eye witness testimony to help understand what happened and to get a conviction. The defence also only needs to raise reasonable doubt. The accused does not have to prove innocence. Being acquitted of this is NOT the same thing as a court declaring that ‘nothing happened’ or that the complainant lied. He was in fact found guilty and convicted of two counts of assault causing actual bodily harm. He may have a retrial of other counts due to hung juries.
