We would all defend our significant other, but that “touch” does not equal a punch to the head that could kill you. Period. Push, yelling, making a scene - sure. There’s a reason she tried to stop him: he’s overreacted before and she knew he couldn’t control himself.

so, while i agree that the battery did occur, the wife tried to stop the husband, meaning she didnt want him to confront him in that way. if the opposing attorney is as good as you then they could argue that the wife didnt deem it a threat beyond the initial contact, with her even attempting to stop her husband from continuing the altercation, causing the interaction to become assault after the fact

Not at chance. He is not advancing, shows no intention of continuing, even turns partially away. Although my personal opinion is he deserves this, the law doesn't. "a good lawyer" could clearly point out that fact.
