Patrick Noonan is an officer with the North Andover Police Department in Massachusetts who shot an off-duty colleague last year while trying to serve a restraining order that her fiancé obtained against her. Kelsey Fitzsimmons is now on trial for assault for allegedly pointing a gun at Noonan before he shot her. Her defense is that Noonan is lying and shot her when she pointed a gun at herself, not him. Fitzsimmons, 29, chose a bench trial instead of a jury trial, so Judge Jeffrey T. Karp in Essex County Superior Court in Lawrence, which is northeast Massachusetts, is hearng evidence and will decide the case. Noonan began testifying on Monday (March 23) and finished today. In this clip from Monday, he testifies about the moment he shot Fitzsimmons. He and a colleague served her with the restraining order and were going to take her baby son to stay with his father. Fitzsimmons was an officer with Noon at the police department, and they'd responded to calls together. He was upstairs with her as she gathered things for the baby when she "appeared with a gun and pointed it right at me and pulled the trigger," he testified. "Can you describe or show us how she did that?" asked Assistant District Attorney James Gubitose. "Yep. So when she came around the frame here, she came up and clicked," Noonan answered. "Where was it pointed?" Gubitose asked. "My face," Noonan answered. "After it clicked, what happened?" Gubitose asked. "I screamed her name. I was completely shocked. She had the drop on me ... which means she had the tactical advantage over me," Noonan answered. "I drew my weapon. She was already backpedaling, and she was doing what we call a tap rack. Basically, when you do a tap rack, that's when your gun malfunctions. So when you tap the magazine, you want to make sure it's properly seated in the magazine well, and then you rack the upper receiver or the slide. So a tap, tap and a rack," Noonan testified. Noonan said Fitzsimmons "did it twice." "So the first time she did it ... it was slow motion. I could see her hand slide off the top of the receiver. She started moving her way around the bed, and she began tap racking again, and I was yelling at her, 'Don't do it. Don't do it,'" Noonan testified. “And then what happened?" Noonan answered. "After she successfully got around in the chamber, her right arm started to come up, and I shot twice in rapid succession at her," Noonan answered. "What did you observe after you fired the second shot?" Gubitose asked. "I saw her flinch. The gun went down, so I stopped shooting. She stopped her action, and then she went to the ground," Noonan answered. "Where was she at this point?" Gubitose asked. "On the opposite side of the bed, in between the wall and the bed," Noonan answered. "What did you do next?" Gubitose asked. "I covered down on her," Noonan answered."And what does that mean?" Gubitose asked. "I kept my gun on her or in the area of where she was, because I couldn't really see all of her at that point," Noonan answered. #law #police #crime #thinblueline
