She was asked whether she was part of the Catholic Church. Then came the question: Was she aware that, according to the Catholic faith, murder is considered a mortal sin? And almost immediately — sidebar. When court resumed, the judge made it clear to the jury that the religious reference was NOT something they were to consider. And there’s an important distinction here. This jury is not deciding whether what happened was a sin under Catholic doctrine. They are deciding Lindsay Clancy’s criminal responsibility under Massachusetts law. The prosecution’s apparent point is understandable: they want to establish that Lindsay understood killing was wrong. But knowing what your religion teaches about murder and being legally capable of appreciating the wrongfulness of your actions during an alleged episode of severe mental illness are NOT necessarily the same question. That is exactly what makes this trial so complicated. The defense says Lindsay was suffering from severe mental illness and was not criminally responsible. The prosecution says she knew exactly what she was doing. And the judge apparently did not want religion becoming another lens through which this jury decides it.
