Also CHILDREN, if you have a child within the year separation window (plus 6 months post divorce) the baby is ASSUMED to be father by your previous husband. No one else may be put on their birth certificate. PLEASE may this a point that needs to change, I understand fathers need protection as well but DNA tests can be done at birth ❤️thank you for all you’re doing!

Up until like last year, in Missouri you couldn’t get a divorce if you were pregnant 😳 Like whyyyy was that even a law. And it was just changed!!

Same up here in Canada, legally separated for 1yr. Then you can file for divorce, that timeline varies depending on terms. Once signed, there's another 30 days waiting to period for it to be finalized 'incase either party changes their mind'.

NC divorce attorney here….its not just the year. Then you have to serve him (must give sheriff opportunity first…after they try and fail, then you can hire private process server to hunt them down)…that can take a while (my longest case took A YEAR). Then they get 30 days to respond. Then they can enlarge time by 30 more days. Then you can file a motion for summary judgment. And serve them. Same process. Again. Then request a hearing. THEN you can actually get in front of a judge to enter a divorce. It’s usually a year and a half.

It’s the same in VA… for those of us attempting to get out of an abusive marriage.. guess what.. it’s an extra year of abuse including financial abuse…10 years later…I still experience it..Not all wounds heal but some wounds could heal more quickly with these laws were abolished. Thank you Jen for attempting to take away of what I call “the year of terror”.

I was able to file on Saturday after a year of separation. I still do not know how I got him out. He refused for years while abusing me and the children. I applied for legal aide and I pray they can help. I am one step closer to freeing us.

Also- since NC is a no fault state, if a woman qualifies for alimony, she is unable to cohabitate or get married again during the DURATION of the time she gets alimony. So, the ex-husband can live with/ marry whomever! But the woman, bc she gets the money she deserves (think stay at home mom who was married for 20 years. She would be die alimony for 10 years, yet during that time- she cannot get remarried or live with anyone else! I understand they’re trying to avoid her “double dipping” but that rarely is the case. It’s just an archaic law that benefits the patriarchy and punishes women.
