If you aren’t there to actually engage in the trial, it’s because 1 of 2 reasons..1) micromanaging or 2) it’s going to be a high bill to the client and you want to appear as though the full force of the law firm is being utilized to justify the billing.

Give her advice or discussion at the table . Do no question anyone. That would take away from her role and being in charge of the case. Let her go but be a helper and assistant and whisper advice don’t act like the boss in front of the jury.

Both of you need to Dress and act the part. You have to act like the helper, and look like the helper. She has to look like and act like the person in charge. So she needs to dress in the suit and maybe you wear something less. Like no jacket. She asks you for documents,.you hand them to her. Maybe don’t be taller than her. When the jury can see you coming in and out of the courtroom, she walks in front of you. She carries the briefcase, you carry something else. (I don’t know what. I’m not a lawyer.) She would take the main spot at the table, whatever the main spot is. One thing for sure, if I was standing and talking, and I had somebody sitting next to me who handed me documents I would think I would tend to present the image of that person being the helper. Plus, if it’s really a visual thing, there are lots of little things she can do to look older. Older people dress a little differently (probably less stylish) and younger people. Hair, makeup, clothing all factor into making someone look older or younger.

I am an attorney & have heard this comment before too from jurors. I think if you are present and helping, like handing her exhibits or if she needs to consult you with a question, that’s fine. I think presenting more as an equal/helper stops that problem, I also think it’s more of a problem for male senior attorneys over women associates due to the subconscious bias most people have about the profession being male dominated.

When she introduces you to the jury, she should not say your firm name, which is yours, and introduce you as her co worker. As for involvement, I’d recommend taking a few parts so the associate has time to take a breath during trial.

Maybe just sitting at the counsels table to pass her a note if she forgot something but also to keep her documents organized as if she were senior counsel and you are her assistant

I would simply observe two attorney colleagues working together. The age of the attorney would not matter to me at all. Perhaps if I saw a young attorney acting inappropriately combative, it might have a negative impact, but short of that, my opinions wouldn't be impacted. I wouldn't make changes to how you think the case should be tried most effectively. Having multiple attorneys present and working together, even if only one is doing all the questioning, would not seem weird or off-putting to me at all. If you tried to step in to question just one or two witnesses, it might impact the flow of the trial in a negative way and appear more awkward. Even though it was a jury convention, not sure all of their assessments and opinions were logical and useful.

I dont think you should be there at all. If its her trial, its her trial. Regardless of your intent (& your heart is in the right place), your presence undermines her. Subconsciously she will wonder whether she is meeting your expectations, which leads to 2nd guessing, hesitation, & lack of confidence. Get her prepped up, sure. But before the jury comes in, exit the courtroom and let her work her own magic.

As a juror, I would appreciate it if the associate explained that she is getting trial experience with the help of her senior. It's something everyone can relate to and she would come across as sincere. I would tend to pull for her because I see she's not trying to BS me or be arrogant.

Simple. Put on the opposite appearance. She whispers to you and you shuffle the papers. She wears the suit, you dress as paralegal. during trial, she whispers to you, you leave and come back with a folder. That sort of act.

I would think best to be there. If for no other reason than to see how it went and any corrections needed and in case you really need to jump in

I’ve been on 11 juries split between county circuit, county grand jury, and federal. Yes, I get picked EVERY time I’m called. Being organized, clear, concise, and confident goes a long way. I’ve seen young lawyers be vey good at their jobs, and lawyers from a federal prosecutor’s office, be a disorganized mess. You being there wouldn’t have an effect on me. It’s all on the lawyer presenting the case.

Confidence in your staff is key. If you think she(he) needs help, go for it. You’re the boss, tough choices on a daily basis
