Former Major League Baseball pitcher Scott Erickson finished testifying today in the civil trial over a wrongful death lawsuit filed by the parents of two boys hit and killed by Erickson's girlfriend when she was impaired and speeding in her SUV. His lawyer Jeff Braun asked about Erickson being charged with reckless driving after his girlfriend, Rebecca Grossman, hit and killed young brothers Mark and Jacob Iskander while she and Erickson were speeding in their SUVs in Westlake Village, California, on Sept. 29, 2020. Grossman is serving 15 years to life in prison.
"What happened with that charge?" asked Braun, a partner at McNeil Tropp & Braun LLP in Newport Beach. "That charge was dismissed," Erickson answered."What is your understanding of why it was dismissed?" Braun asked. "They didn't have evidence," Erickson answered.Attorney Brian Panish, who represents Nancy and Karim Iskander, interjected. "Excuse me, Your Honor, I move to strike. He should be admo — That's not what happened. We all know. Totally improper. He should be admonished, and the jury should be instructed. Counsel should be admonished," Panish said as Judge Huey Cotton said, "Yeah." "The answer is stricken, everything about why," the judge said. "Do you know why it was dismissed?" Braun asked. "Let's try this again," Judge Cotton said. "No," Erickson asked. "What was done by you in response to the charge?" Braun asked. "I did a PSA announcement," Erickson answered. "Whose idea was that?" Braun asked. "Myself and my lawyer offered to do that," Erickson answered. "And what was the PSA about?" Braun asked. "Safety. Being safe while driving a car. Paying attention," Erickson answered. Erickon said the video went to "the four principals of the four local high schools in the Westlake area" and "Ms. Grossman and I did the video," Erickson answered. "And was the charge dismissed before or after the PSA? If you know," Braun asked. "I don't know," Erickson answered. "Were you ever charged with speeding?" Braun asked. "No, I was not," Erickson answered. Panish interjected, "That's exactly what he was charged with." Judge Cotton sustained the objection and ordered the question and answer stricken from the record. "What was the grounds for the objection, Your Honor?" Braun asked. "Hearsay. Hearsay, best evidence," the judge said. "Were you ever charged with anything else related to your conduct on Sept. 29?" Braun asked. Juge Cotton sustained an objection. "On what grounds?" Braun asked. "Hearsay, speculation," the judge said. "Do you know whether you were charged with anything else from the events of Sept. 29, 2020?" Braun asked. "No, I was not," Erickson answered. #law #court #driving
