The brakes were only applied for one second, from minus 1.5 to minus point five and then released," Hale said. "And so at the point of impact, were the brakes being applied at all?" Owen asked. "No," Hale answered. Earlier in the exam, Owen asked Hale if he believes his analysis "with an open mind" and "without any predetermined conclusions." "I'm absolutely certain that I did," Hale said. You know the testimony is critical when the defense objects to anything they can think of like Grossman's lawyer Esther Holm did here. Judge Huey Cotton overruled all but a foundation objection to the 73 mph on impact conclusion, so Owen questioned Hale about his process and tried again, and the judge allowed the testimony.
