A California jury in a wrongful death trial over a vehicle-pedestrian crash that killed two young brothers heard today how the driver's boyfriend told police he was driving a different vehicle, and he switched the license plates to try to trick the boys' parents' lawyers. Scott Erickson retired from Major League Baseball in 2006 after playing for 15 years. He and his girlfriend, Rebecca Grossman, were speeding alongside each other in their SUVs on Sept. 29, 2020, when Grossman's SUV struck two brothers who were crossing the road in a marked crosswalk with their mother and younger brother.  A jury in 2024 convicted Grossman of two counts of second-degree murder for killing Mark Iskander, 11, and Jacob Iskander, 8, as well as two counts of vehicular manslaughter with gross negligence and one count of hit and run driving resulting in death or serious injury. She's serving 15 years to life in prison. Erickson was not charged with a crime. The boys' parents, Nancy and Karim Iskander, are suing Grossman, Erickson and Grossman's husband, plastic surgeon Peter Grossman, for wrongful death. Their lawyer Brian Panish told jurors about Erickson avoiding responsibility in his 90-minute opening statement this morning (Friday, April 24).

"Mr. Erickson admits that he went back to the scene and watched for three hours, but never once — once — told the police officers with two deaths. 'Sir, I know something.' Never, ever. And you'll be able to assess whether someone that's impaired would leave the scene. Would a sober, unimpaired driver stay and tell the police what happened? You're going to assess that," Panish said. "Hiding in the bushes. This is a grown man, 15 years in Major League Baseball. 15 years in the public eye. Sees two children killed while he's racing some — his girlfriend under the influence, and leaves the scene," Panish said. Panish said "we want to inspect the vehicle," and Erickson brought them two. "First of all, he tells the police he's driving a different vehicle. So he misstated to the police, and there's numerous other things he told the police that weren't true. But what he does, it's called cold plating, and it's well known in the law enforcement area that people will put plates on different cars," Panish said. "Mr. Erickson intentionally flipped the plates gave the wrong car to be inspected. Who does that? Does someone that has guilt, that feels responsible do that, or are they fair and honest and trustworthy and have integrity? ... He was a 15 year Major League Baseball player in the public eye all the time. He has to know better than that."
