As a certified diver , this is fucked up even at 40 feet if he couldn’t gain enough air in his lungs to preform CESA (basically take a last breathe let out small air bubbles till you reach the top to prevent the lungs from exploding) he could have died very easily because of this he deserves jail time and never allowed to be on the water again
