Her civil complaint against the providers details what happened from her perspective. She remembers what happened, she knows what she did. I think people want it to be him & not that the system is so flawed that someone doing all the right things to get help was failed while others want to so badly misunderstand the situation bc they need her to be a monster. It’s such a sad situation all around.

The public failed Andrea Yates so badly that we are over correcting with this case

The instant that she said, she did not know what was real, and what was not should’ve been the moment which she was separated temporarily from her children and hospitalized for potential psychosis. End of story.

Ok so from a perspective of someone whose family went through something similar, the defense team will only do what she tells them to do. If she believes she did it and she tells them not to pursue someone else, that is what they will do. So many people take the entire blame to save those they care about.

Defense attorneys don’t file charges against people.. her defense attorney isn’t going to be “going after” her husband. That isn’t how this works.. the absolute ignorance from some of these people is mind blowing.

In Massachusetts (and under Mass. R. Crim. P. 12), "not guilty by reason of insanity"—legally termed a lack of criminal responsibility—is not a standalone base plea type. Instead, a defendant enters a standard plea of not guilty, and then raises the defense of a lack of criminal responsibility. Because you are already pleading not guilty, you can drop or alter your reliance on the mental-state defense strategy during trial, subject to the trial judge's control over evidence and trial procedures.

I feel like a nasty side effect of having the kind of internet access that we have is that everyone thinks they know everything! Yes professionals can be wrong, yes professionals can be corrupt. But that doesn’t mean we know more than the person that studied extensively to do the job they do. Our egos have gotten way too big (and AI is making it worse).

They may not know better than the defense team but I honestly don’t think anyone is on their side and I believe the cops were like oh perfect this is wrapped up neatly and prosecutors took it and ran.

The only thing that gave me pause was her body temperature, but a doctor said temperature regulation can be impacted by spinal injuries. She was failed, but she did it.

Her defense team offered to not go to trial for the actual murder charge (just the insanity portion) and the prosecution refused.

Ok question - several tik tok lawyers are saying since burden of proof is on the state that there’s really 3 outcomes. 1 guilty 2 not guilty by mental state -and 3 not guilty bc reasonable doubt state didn’t prove she did it Is this correct? https://www.tiktok.com/t/ZP8Wd3EcF/ so outcomes are: 1 - jail 2- mental hospital 3 - just not guilty

Based on what’s happened in this trial only and if she had never admitted to anything. I don’t think they would be able to get a conviction. Not that she didn’t do it.
