That is battery not assault. People always get them wrong. Assault would be the threat to harm someone. battery is the unwanted touching of someone.

The “lawful exercise of police duties“ has been interpreted very broadly by the Supreme Court. And let’s not forget that the SCOTUS has also held government buildings/offices are a “limited public forum.” Meaning you only have a right to be there if you’re there to conduct business (unlike a public park for example.) Successfully prosecuting a police officer under these circumstances would be extremely difficult. I understand that may not be what some people think is “fair”, but that is the reality of the situation under our legal system. And my job on this channel is to give it to you straight, without bias! Even if it’s unpopular. 😅
