This email is in response to your inquiry regarding the immigration concerns of your constituent, ***. Please note that the adjudication of your constituent’s Form I-765 will not precede the adjudication of their concurrently filed Form I-821D. According to USCIS electronic records, this Deferred Action for Childhood Arrivals (DACA) renewal case continues to maintain its placement in a processing queue where additional vetting of the case will be completed. Based on our communication with the pertinent adjudicative unit at the Nebraska Service Center (NSC), we are informed that the consideration of expedited processing requests in cases of this type is significantly limited. Concerns regarding a lapse of deferred action and employment authorization, which are often connected to claims of severe financial loss and humanitarian concerns, are common in these cases. Expedited processing requests which are fundamentally based on these prevalent concerns are often not accommodated. With respect to this DACA renewal case, the submitted documentation outlining your constituent’s expedited processing request and the circumstances which are prompting it was reviewed. Your constituent’s request for expedited processing will not be accommodated. Please note that details pertaining to this discretionary determination are not available. The USCIS Policy Manual (https://www.uscis.gov/policy-manual/volume-1-part-a-chapter-5) states the following: “…to increase efficiency in processing expedite requests, USCIS generally does not provide justifications regarding expedite decisions.” We cannot predict the date on which the final stage of processing for a specific Form I-821D and Form I-765 will be completed by an officer. It is important to note that the estimated processing timeframe for cases of this type has extended beyond 6 months. The NSC is working diligently to process these cases as quickly as possible. Major case status updates (for example, an update regarding the issuance of a USCIS decision notice) should be available through the “Case Status Online” tool (https://egov.uscis.gov/casestatus/landing.do) and your constituent’s USCIS online account (
